Does Your Business Know its Legal Obligations for Disposing of Waste?

Businesses based in England and Wales have a legal responsibility to ensure that the waste that they produce is stored, managed and disposed of safely, in line with existing waste legislation. This is known as your 'duty of care'.

 

How Do You Safely Dispose of Waste?

But what is the correct way to dispose of your commercial waste? And what do these waste management laws say? Well, The Environmental Protection Act 1990 is an important act to take notice of. This legislation outlines a system of integrated pollution control for the disposal of waste on land, water and air in and around Wales, England and Scotland.

To quickly determine if you are disposing of your business waste legally, without reading this hefty document, GD Environmental recommends you ask yourself the following questions;

  • Does your business have a commercial waste agreement with us or another authorised waste carrier?
  • Does your waste carrier issue you with a Waste Transfer Note, either annually, or for each movement of waste?
  • Is your waste collected in an appropriate container? For example, a GD Environment 100 litre wheelie bin, or a GD skip?
  • Are your waste containers removed from the footway as soon as possible after collection?

 

If you answered ‘no’ to any of the above questions, then you may be breaking the law, particularly if your business is producing controlled waste but you do not have the Waste Transfer Document. If prosecuted you could face a hefty fine of up to £5000.
